A GLENORMISTON man who breached a suspended jail sentence when he kicked in his brother’s car, causing $2846 damage, has been lucky to avoid spending time in prison.

Aaron John Burrow-Buck, 20, of Castle Carey Road, pleaded guilty in Warrnambool Magistrates Court last week to causing criminal damage.

On July 6 last year, he had consumed eight beers while drinking at Warrnambool’s Royal Hotel before being picked up by his brother.

They went to a friend’s house to work on a car but finished up arguing and Burrow-Buck walked off before returning and causing damage to his brother’s car.

He kicked in a headlight and left a number of foot-size dents in the body of the car.

In February last year, Burrow-Buck was sentenced to serve two months in a youth detention centre after being caught driving while disqualified five times in 15 days.

A further six-month jail term was suspended for two years.

That offending was breached by the damage Burrow-Buck caused to his brother’s car.

Defence counsel Danielle Svede said her client now had a job and claimed Burrow-Buck had turned his life around.

She described Burrow-Buck causing damage to his brother’s car as a hiccup and she called for her client to be given one more chance to avoid going back into custody.

Magistrate Jonathan Klestadt found that there were exceptional circumstances which allowed Burrow-Buck to avoid serving the suspended sentence.

“I am very encouraged to hear what you have done. They are the best and longest strides you have taken to keep you away from court,” he said.

The magistrate described Burrow-Buck’s offending as an almost childish outburst.

Mr Klestadt said that since the offending Burrow-Buck had engaged well with support services and a report indicated a significant change of heart and behaviour.

“He seems to have taken the opportunity to engage with alcohol, drug and mental health services,” he said.

The magistrate said Burrow-Buck had repaired his relationship with his parents, found work and his partner gave evidence of his huge change in lifestyle.

Burrow-Buck was ordered to pay compensation to his brother for the vehicle damage.
